The East Dorset District Council (Off-Street Parking Places)

(Consolidation) Order 2016

Notice is hereby given that East Dorset District Council (hereinafter referred to as "the Council") has made an Order in exercise of its powers under Sections 32,35, 35A, BandCand PartsIIIand IV of Schedule 9 of the Road Traffic Regulation Act 1984 ("the Act of 1984"), the relevant powers under Part 6 of the Traffic Management Act 2004 (TMA 2004) and of all other enabling powers, in accordance with Regulation 21 of the Local Authorities' Traffic Orders (Procedures) (England and Wales) Regulations 1996 and after consultation with the Chief Constable of the Dorset Police and with the consent of the County Council of Dorset in accordance with Section 39(3) of the Act of 1984.

The general nature and effectof the Order is;-
1. To revoke the Orders specified in the Schedule below.

2. To re-enact the provisions ofthose Orders (and ofall amendments subsequently made to those Orders) withoutanychanges of substance having been made, other than those necessaryto;

a) Reflect the Council's commencementofCivilParking Enforcement(underthe provisions ofthe TMA2004) on the off-streetParking Places which itoperates, and

b) Update the provisions concerning the methods by which the charges for the use ofoff-streetParking Places may be made, to reflect the various paymentoptions which arenow available.

This Order has been made for the purpose ofintroducing the above changes, to confirm and clarify the existing rules and regulations pertaining to the use ofthe Councils off-streetParking Places and to bring all ofthe Council's Orders relating to those Parking Places together into a singledocument. It does not amend any of the pay and display/ pay by phone parking charges which currently apply to the use of its car parks.
The Order will come into force from 13th June 2016. A copy of the Order may be inspected during normal office hours at East Dorset District Council, Furzehill Wimborne BH214HN.

If any person wishes to question the validity of the Order, or any of its provisions on the grounds that it or they are not within the powers conferred by the Road Traffic RegulationAct1984,or that any requirement of that Actor of any instrument made under the Acth as not been complied with, that person may within six weeks of the date on which the Order is made (2nd June 2016)apply for the purpose to the High Court.
